Upchurch Parish Council Report - May 2013



The Parish Council met on Thursday 4th April 2013 in the Hall of Holywell Primary School where 6 Councillors were present and 5 members of the public.
Public TimeRural Crime – A resident expressed concerns about petty crime in the village. It was reiterated the importance of reporting crime to the Police. Please report non-urgent crime on the non-emergency number 101. SW/13/0030 Hursell Farm – The resident also commented on this planning application for change of use of land to gypsy site. They questioned whether a public footpath would be kept opened if this application was granted. It was felt that this footpath would not be affected.  Issues with people using footpaths – A resident explained that the Footpath Officer from KCC had visited him recently to follow up a complaint regarding his horses kept in a field close to Horsham Lake. He reported that the Footpath Officer was assured that his horses were not causing any danger to people using the footpath and explained the issues that he was experiencing. His horses had been fed by people passing by which meant that they now associated anyone walking though with food. Children aged between 6 and 10 were using a corner of the field to make a camp which he didn’t mind. However, they were now throwing things at the horses. Dog walkers were not clearing up after their dogs and often let their dogs run loose. Members have asked that residents note these issues and avoid them continuing. Please show respect for the horses in the field and co-operate with the land owners. Water at the Allotments – A resident asked why the water had not yet been turned back on. The Clerk reported that there was a suspected leak. Footpaths The resident also commented that he had seen dog walkers letting their dogs run loose across the field and cutting corners. Dog poo bags being thrown in hedges was a common problem in his field. The Council would look into all these issues.
CorrespondenceUpchurch Twinning Group – A letter confirming another Sports Day was being planned by the Twinning Group and would be held in Upchurch on Sunday 1st September 2013. Further details will follow and the venue for the day will be Upchurch Cricket Ground. KALC Community Awards Scheme – Information on a new Scheme being launched. The aim of the Scheme was to acknowledge & give recognition to those who have made a significant contribution to local community. It was a voluntary Scheme and it was hoped that awards would be presented at Parish and Town Council Annual General Meetings in May 2014.Members agreed to adopt the Scheme. Upchurch Village Management Committee – A request for representative trustees to be nominated. Members were advised that the Village Hall AGM would be held on Wednesday 10th April in the back hall starting at 7.30pm. Cllr Tucker agreed to be a representative trustee. 
Planning - The following applications were considered:
 SW/13/0283 2 Macklands Cottages, Otterham Quay Lane – Single storey infill extension with new roof over existing garage. No objections.
SW/13/0306 136 Horsham Lane – Erection of a two storey side extension, roof extension and rear dormer window. No objections.
SW/13/0323 11 Crosier Court – Single storey rear extension to residential dwelling to accommodate extended kitchen. No objections.
TP/12/0155 The Paddock, Rear of 2-6 Bradshaw Close – Fell 4 Robinia trees to rear of 2 Bradshaw Close and fell 2 Holm Oak saplings to rear of 3 Bradshaw Close. No objections.
TC/13/0028 St Marys churchyard, Horsham Lane – reduction of 1 x London Plane by 5-10%. No objections.
SW/13/0331 3 Marstan Close – single storey rear extension. The Planning Review Team had no objections. Members would review this proposal on-line. 
SW/13/0030 Hursell Farm – Change of use of land to gypsy site for two gypsy families (related) and for the siting of one static caravan and extension and erection of dwelling (stable building) and stationing of one touring caravan and use of existing barn as general amenity (retrospective). This application had only just been received; therefore the Planning Review Team will meet to discuss this further.
SW/13/0362 2 Amelia Cottages, Otterham Quay Lane – Two storey side extension. This application had only just been received; therefore the Planning Review Team will look at this proposal on-line.
ix) Permissions and refusals: Application withdrawn: SW/13/0190 11 Forge Lane Single storey rear extension
Permission granted: SW/13/0046 49 Chaffes LaneTo construct a single storey one bedroom annexe for disabled accommodation .

Allotments and Recreation GroundParking on the grass in the Recreation Ground – concern over the number and frequency of vehicles using the Recreation ground as an extension to the car park. This was causing the grass and ground to be churned up whilst vehicles manoeuvre to park and also very dangerous to people wishing to walk through the Recreation ground or access the Scout Hut. Water at Allotments – The Clerk reported that a local plumber had been contacted to quote for installing three stop cocks at the Allotments. Rent due from Allotment holders by 1st April 2013 – The Clerk reported that rent was outstanding from 10 allotment holders. A notice will be displayed at the Allotments informing allotment holders that should payment not be received by 1st May, then tenancy agreements would be terminated and plots reallocated.
Paddock Paddock project – Cllr Tucker and the Clerk had met with Mr Newbery to discuss the Paddock Project that was considered by the Council several years ago. Cllr Tucker explained that the project focused on the vegetation in The Paddock. The aim was to open up the area by removing trees/shrubs/hedgerows so that it became a “Village Green”. It was agreed that Cllr Steward, Cllr Tucker, Cllr Arnold and Cllr Denny would form a sub-committee to progress this project further. 
Burial Ground and ChurchyardBurial Ground Gate – Members had been informed that this gate had been damaged by hirers of the Village Hall. A repair had been carried out by Mr F Osborne and a cheque to the sum of £170 had been agreed for payment. Re-pointing of Church Yard wall – A quote from Gransden Construction to the sum of £2,682 plus VAT had been agreed. It was hoped that work would commence as soon as the weather was warmer.
EnvironmentBroadband project – It was suggested that the Council may wish to carry out a survey by compiling a questionnaire and forwarding the results to BT. All agreed. Best Kept Garden Competition 2013 It was confirmed that this would be organised again this year and it was hoped to carry out judging during July. 
Highways - Horsham Hill – a suggestion for traffic lights being installed on Horsham Hill to allow only one flow of traffic. Members discussed this and Cllr Arnold will refer this to KCC Highways. Also, it was suggested starting a walking bus to help alleviate the traffic congestion during school pick up/drop off times. The Clerk will refer this to the Head teacher of Holywell Primary School. Speed watch –A Dual Message Display System has been brought by the Council and it is hoped to discuss the use of this equipment at the next meeting. The Poles Street Light – Members noted emails from two residents in The Poles. Although one resident expressed his appreciation to the Council for replacing this lantern, another resident commented that no consultation or notification was carried out. 
Next meetings – Annual Parish Meeting - 25th April at 7.30pm in the Village Hall. Everyone is welcome!
Annual Meeting of the Parish Council – 2nd May at 7.00pm followed by monthly meeting at 7.30pm at Holywell Primary School. The monthly meeting in June will held on 6th June at 7.30pm at Holywell School.

Groceries Stolen - Chaffes Lane


Message 247 (XY/009638/13)

2 crates of Grocery Shopping were stolen from the back of a Tesco delivery van as the driver was knocking on the door of his customers house in Chaffes Lane Upchurch.

This happened at 9:05 pm on 29th of March.

Upchurch Twinning Group News


Upchurch is twinned with Ferques-Elinghen in Pas de Calais, France.

School visit to Ferques – On 25th March, years 5 and 6 from Holywell School visited one of the schools in Ferques, this time to Elinghen. As usual, the coach was funded by the Upchurch Twinning Group. As it was in the week leading up to Easter, the Twinning Group sent over small chocolate treats for the children in France with whom our Upchurch children would be spending their day. Many thanks to Upchurch Co-op for helping us pay for this seasonal gift.

16th June – visit to Hever Castle by a group from Ferques – Some of our French friends will be coming to Kent for a day trip on Sunday 16th June. They would love to see any of us from Upchurch at Hever Castle that day.

Sunday 14th July 2013– Bastille Day Fair in Ferques. We always have a stall at this street fair – do plan a day out over there and come and find us.

Sunday 1st September 2013 – SPORTS DAY! In Upchurch – do put the date in your diaries. This promises to be a day of fun and games and we will be welcoming friends of all ages from Ferques. With many thanks to Upchurch Cricket Club, this event will be held at their grounds on Holywell Lane and we look forward to using their wonderful facilities (including their bar!). More details will follow as the year unfolds.

Barn Dance at the Village Hall


The Upchurch Short Mat Bowls Club in conjunction with the Horticultural Society are holding a Barn Dance on Saturday the 7th of September at the Village Hall. Tickets £10 including a Fish and Chip Supper.

They are also holding a Halloween Dance on Saturday the 26th of October. Tickets £8 including a Jacket Potato Supper.

Prizes for the best fancy dress.

Tug-of-War Teams prepare for St. George's Battle


Inter-village pub Tug-of-War Competition. The Three Tuns pub from Lower Halstow won the competition in 2012. Will they win this year ?
Something stronger than pints will be pulled at pubs in and around Sittingbourne over the next few weeks as teams get into training for the annual inter-village pub tug-of-war tournament at the St. George's Day celebrations in Newington on Saturday, April 27th.

The current title holders, the Three Tuns in Lower Halstow, are keen to retain their crown - and the silver trophy that has been proudly displayed in the bar for the past year.

Members of the 10-man squad are preparing to give up some of their Easter holidays to get fit and to practise their technique. The landlady Carol Haines said: "The lads enjoyed their victory last year and I think they're going to be even stronger this year. They're ready to take on any other pub."

However, they face determined opposition, notably from two Upchurch pubs, last year's runners-up the Three Sisters, and new entrants the Brown Jug. Kate Johns, the Brown Jug publican, said: "Bring it on. We're definitely going to take the trophy off the Three Tuns. Everyone's fired up and looking forward to a good day out."

The parish-council organised St. George's Day fete and music festival starts at noon on Newington primary school field with the tug-of-war beginning at 1:00pm. It will be umpired by an official from the England Tug-of-War Association.

Ten highly-talented bands and singers from across Kent and Medway will perform on the festival's main stage from noon until 9:00pm. Other attractions include the Newington School Choir, Newington Concert Party, an Assault Course, displays, sideshows, stalls, fairground attractions, hot food and a licensed bar.

Friends of St. Mary’s Church - Photography Competition


The Friends of St. Mary’s church is holding a photography competition open to all. Prints (6in x 4in or 7in x 5in) of the church or its surroundings should be sent to 135 Oak Lane by 30th September. (Don’t forget to give details of the photographer!).

The entries will be displayed at the Friends of St. Mary’s AGM in October when the winners will be announced. Modest cash prizes for each class winner will be provided together with the opportunity for a small display of winners’ portfolios on the Upchurch Matters website.

The judges will be particularly interested in originality and innovation in the composition of the pictures. Entries at £1 each should be submitted in any of the following classes: 

• Black and white; 

• Under 16 years; 

• 16 years and over; 

• Creative i.e. manipulated images.

Charity Cake Bake at the Crown - Amount Raised

The Charity Cake Bake on Sunday the 24th of March at The Crown raised a grand total of £230.

Proceeds will go to Sarah Oakham who is running the 2013 London Marathon in aid of Cancer Research UK.

The Gullands Guide To Motoring Offences



For most people the mere sight of someone being spoken to by the police on the side of the road prompts them to slow down and consider how they would feel if they were in the same position.

The penalties if convicted of a very serious traffic offence can be high. For example, causing death by dangerous driving carries a maximum penalty of 14 years imprisonment.

For many, however, the prospect of losing their driving licence is a much greater possibility, and in these circumstances it is prudent to take expert legal advice from a solicitor.

Most road traffic offences, such as going through a red traffic light or driving in a bus lane, will add penalty points to your licence. Offenders who reach 12 points within three years, known as ‘totting up’, become liable for disqualification. A first disqualification is for a minimum of 6 months.

Not all motoring offences are endorsable but those that are carry a minimum of three penalty points with some, such as speeding, carrying a range of points depending on the seriousness of the circumstances. If you are caught speeding on a motorway and the measured speed exceeds 100mph, for example, the magistrates’ court will always consider a period of disqualification.

Where a person is offered a fixed penalty, this would be for three penalty points and currently a £60 fine. If they wish to dispute the offence or where the addition of penalty points would result in the driver totting up, they will be summonsed to attend court. If convicted, the magistrates can impose a greater number of points and a higher fine.

A magistrates’ court has discretion not to disqualify a driver, or disqualify for a period less than six months if, on hearing evidence, it considers that loss of licence would result in exceptional hardship.

An alternative solution available to the court is to impose a discretionary disqualification for the new offence, typically for a period of between seven and 56 days. This allows the court to mark the offence with a shorter disqualification, avoiding the need to consider whether exceptional hardship arises.

Upchurch 50 Years Ago in March 1963

Once snow from the prolonged winter had completely cleared life became easier for village residents, particularly on the roads as the big freeze had curtailed travel and had periodically prevented the school bus from turning up to collect the village school children. Accidents became fewer although the last one reported in the East Kent Gazette involved 16 year old Ralph Stokes from Holywell Cottages who collided with a pedestrian in Solomon Road in Rainham on his motor scooter due to an icy road.

In religious affairs Reverend Bradshaw continued to educate villagers in the workings of the church and wrote about the importance of Lent as a period of penitence and self discipline in the village magazine. Meanwhile, the church choir which had made good progress under the leadership of Mr. Wheeler advertised for tenor and alto singers. Later in the month the Bishop of Dover visited the church to attend confirmation.

Although the football club didn’t play any matches until well into the month due to unfit pitches, fifty members of the Women’s Institute managed to attend their usual monthly meeting in the village hall. After arrangements had been made for the annual birthday party guests from the Darby and Joan Club were shown a film. The evening was rounded off with a competition for a child’s knitted garment won by Mrs. Turner.

In parish council affairs nothing happened in March as only four members turned up to the monthly meeting because of bad weather and important issues had to be shelved. At about the same time the council received an interesting letter from former Upchurch resident Frank Twort who wished to share some of his memories of the village from New Zealand. The letter revealed that he had been born at Anvil House, Forge Lane in 1884. He later attended the village schools and sang in the church choir before working in Lower Halstow brickfield for 1/6d a day doing hard physical work during the late 1890s. He also recalled enjoyable evenings at the vicarage in the company of Reverend Trew and his daughter where he played various games and was served with tea and cakes. He then moved to Newington and later to New Zealand where he became a magistrate and Justice of the Peace. He finally obtained fame when he became mace bearer in the New Zealand parliament and an example of somebody who had worked his way up in life from humble
 beginnings. 

Church burials for March included well known village character Kate Seamer aged 73 from The Street and Jacqueline Millen aged 44 from Jasmil Kennels while marriages included Peter Whitton from Kent Terrace with Patricia Haynes from Gillingham, Vicky Gardner from Oak Lane with Lionel Craggs from Abingdon in Berkshire and Roystan Wildish from Drakes Close with Valerie North from Newington. Finally, Malcolm Swift from Chaffes Lane, Michael Apps from Twinney and Stephen Bass from Webb’s Cottages, Ham Green all celebrated birthdays in a month where a big improvement in the weather brought relief to Upchurch residents after one of the longest and coldest winters in living memory.

Upchurch Parish Council Report - April 2013


The Parish Council met on Thursday 7th March in the Hall of Holywell Primary School where 8 Councillors were present and 10 members of the public.
Public TimeSW/13/0152A resident explained that he had come along to answer any questions the Council may have regarding this planning application at Horsham Plantation Yard. Swale BC Sports Development ServiceCllr Wright summarised the proposed changes to this service. Swale BC was looking at alternative ways to delivering this service due to financial pressures. Footpath leading to The Poles – A resident raised concerns about a continuing issue with human excrement along this path. It was thought that this issue was caused by people taking part in all night fishing. Members offered to look into this issue. Water at the Allotments – A resident asked if the water could be turned back on at the Allotments and the Council agreed. Lorries delivering to the Co-Op A resident reported that a situation had occurred recently where 3 Lorries were all trying to deliver to the Co-Op causing chaos. Cars were trying to reverse in all directions and also the Bus was trying to get through. The Council offered to look into this and the resident gave members photographs she had taken. Broadband – Cllr Lewin reported that there was no update. BT had acknowledged his email and suggested that there may be a variety of possibilities to take this forward by involving communities. He encouraged residents to contact BT to let them know that they would sign up. He hoped that we could urge more residents to locally campaign BT and asked anyone who was interested in this to contact him.
CorrespondenceCitizens Advice Bureau in SwaleIt was agreed to forward a donation of £65 towards their operating costs in the coming year. 
Planning - The following applications were considered: 
SW/13/0046 49 Chaffes Lane – To construct a single storey one bedroom annexe for disabled accommodation – No objections.
 SW/13/0152 Horsham Plantation Yard, Horsham Lane - Change of use from B1 to car sales & showroom- No objections however the following comments were raised: Provision for visitor parking – ample parking should be provided, Volume of traffic generated – projected figures for vehicles accessing the site should be monitored, Lighting – this should be monitored and Other consultees’ comments should be given serious consideration.
SW/13/0190 11 Forge Lane – Single storey rear extension - Members were asked to review this planning application on line. 
Permissions and refusals – the following decisions have been received:
Permission granted (Temporary – whilst the applicant is resident on the site):
SW/12/1472 Hedgerows, Holywell Lane – Retrospective application for the change of use of land for the stationing of two mobile homes for use by a gypsy family with associated utility room, 4 vehicle parking spaces and hardstanding. 
Allotments and Recreation GroundPlanting of Trees for Jubilee Celebrations – Members thanked Cllr Kennard for planting the two trees in the Recreation Ground. The General Purposes Committee would discuss the arrangements for a plaque. Request to use Recreation Ground for fitness classes – The Clerk reported that these classes had started and there had been a good response. Vacant Plots at Allotments – It was agreed that allotment holders would be allowed no more than two full plots. 
Paddock Fly-Tipping – It was reported that a sofa had been dumped in The Paddock behind the trees. Also, the Village Cleaner had cleared empty aerosol cans from this area. The sofa had been reported to Swale BC and also PCSO Cork had been informed of the situation. Funding opportunitiesCllr Steward reported that there were various grant funding opportunities available to the Council, in particular with BIFFA and Viola. However, in order to make a grant application, you needed to submit a plan. Sovereign Play Manufacturers had sent him a Play Equipment Funding Pack and would be prepared to draft a plan at no cost to the Council. It was suggested that the Council take up this offer and consult Phil Newbery. 
Burial Ground and Churchyard – re-pointing of churchyard wall – Members would discuss quotes received for this during confidential session at the end of the meeting. Laurel Bush in Lower Burial Ground - Members were asked if this should be removed or given a rigorous cut. It was suggested that the General Purposes Committee investigate this further, however it was noted that any trimming back would have to wait until July when the birds nesting time was over. Future capacity of the Burial GroundCllr Rossiter commented that the Council should be making positive moves to looking into an extension for the Burial Ground. It was suggested that this was a Policy decision for the whole Council and required further discussion. Cllr Rossiter, Cllr Denny and the Clerk would meet to discuss this further.
EnvironmentVillage Cleaner – Members noted the appointment of Marina Fenton. 
Highways - Narrowing roads in UpchurchCllr Arnold reported that he had consulted Kent Highways regarding this. Highways will be contacting landowners to remind them of their obligations to keep hedges trimmed back. Pedestrian safety in Horsham LaneMembers was reminded of a request by a resident to improve pedestrian safety where the footpath ends in Horsham Lane opposite the garage. The resident had met with PCSO Cork. Cllr Arnold will request Highways use a white line in the road to define the footpath. Members discussed other suggestions e.g. installing a sign “Pedestrians in road”, laying cobbles in the road. Cllr Arnold will discuss this further with Highways and the Clerk will follow this up, copying in Cllr Keith Ferrin. Highway IssuesCllr Arnold explained that members could report highway issues via the website:  www.kent.gov.uk  by clicking on the link “Report a fault on the road or pavement”. 
Next meeting – Confirmed as being 4th April in the hall of Holywell Primary School starting at 7.30pm. Annual Parish Meeting 2013will be held on 25th April at the Village Hall starting at 7.30pm. Please note the Annual Meeting of the Council will be held on 2nd May starting at 7.00pm followed by the monthly meeting at 7.30pm.

John Uglow


It is with a sense of deep sadness that the One O’clock Club report that we have lost one of our original members, John Uglow, who passed away peacefully at home on Tuesday 5th March following a battle with cancer.

John moved to the village in 1964 and served the community on numerous committees including the Parish Council and the Village Hall besides fund raising with the One O‘clock Club.


The club organised Bonfire Nights in the Paddock for many years along with New Years Eve parties in the Village Hall and Scout Hut.

John’s generosity, expertise and commitment to our community will be sadly missed.
Our thoughts are now with Jill and all the family at this sad time.

Darby and Joan Easter Bazaar


Upchurch Darby and Joan host their Easter Bazaar at the Village Hall on Wednesday the 20th of March from 10.30am - 12:00pm.

There will be a Grand Raffle, guess the weight of the Easter Cake, Craft Stalls, Brik a Brak, Tombola, Refreshments and homemade Cakes etc.

All funds raised will go towards Christmas dinner for their members.

Attempted Break In - Barn Chaffes Lane


Message 154 from Neighbourhood Watch

Unknown persons made a determined effort to open a barn door in Chaffes Lane, Upchurch breaking the wooden surround and window. This occurred overnight between 25th and 26th of February.

Charity Cake Bake at the Crown


The Crown Upchurch is holding a Charity Cake Bake on Sunday the 24th of March 3:00pm - 6:00pm.

Come and buy Homemade Cake and Scones to take home or enjoy them in the Pub with a lovely cup of tea or coffee.

Proceeds will go to Sarah Oakham who is running the 2013 London Marathon in aid of Cancer Research UK.
