Upchurch 50 Years Ago in October 1963

The month began with a wave of vandalism which hit the village and this had to be dealt with by the parish council who reported smashed street lights in Forge Lane caused by vandals thought to be from outside the village.
At their monthly meeting the parish council announced the approval of street lighting for The Poles estate and reported that responsibility for field and fence management at the recreation ground had been given to the football club in return for free use of the ground. Both the football club and the parish council appealed to the public to stop dumping litter on the recreation ground explaining that it hampered the mowing of the grass. Meanwhile, at the same meeting Edith Colven and Cliff Wanstall were re-elected school managers of the Infant’s School.
The parish council continued to search for a suitable location to be converted into a children’s recreation area while parish clerk Aubrey Smith reported that progress had been made for a new burial ground to adjoin the old one which had become full, a problem that has recently re-emerged in the village.
The biggest event of the month took place on the last Saturday of October with celebrations in the village hall for the building’s second birthday.  A variety concert raised money and many village organisations participated. These included the Women’s Volunteer Service, Young Wives, the church choir, the Brownies and The Upstarts theatrical group. Entertainment consisted of musical melodies, comical sketches and village rock star George Chaney gyrating with his guitar in front of large numbers of screaming teenage girls in the audience.
A popular sketch that caused great amusement involved Aubrey Smith as a school headmaster trying to keep order with naughty children. As a school teacher in real life he played the part very well. This was followed by The Upstarts who performed a one act play called ‘Orange Blossom’ with actors Dee Eastwood, Christine Wright, Jayne Batchelor, Louie Parker and Mike Brady while at the end of the evening The Women’s Institute choir sang ‘Birthday Candles.’
The Women’s Institute had an interesting monthly meeting with a talk by Mrs. Griffiths about Staffordshire China. She showed examples of the items and told a series of fascinating stories from legends and fairy tales that the china represented. After the talk Mrs. Thompson won the monthly competition.

David Wood.
In sporting affairs the football club became involved in some high scoring and exciting games with a 4-4 draw against Walderslade, a 4-3 defeat against Hoo and an 8-5 defeat against Elliotts Reserves in the Kent Junior Cup. In a remarkable match in which Upchurch led 3-1 at half time, Elliotts staged a remarkable second half comeback to win the game. The matches involved well- known Upchurch players like Ken Wildish, ‘Nippy’ Edmonds, Basil Barden, ‘Trotter’ Horsnell, Wilf Busbridge and Brian Stephens.
The scout group suffered a blow when Peter Bowden and his wife from Oak Lane announced that they were going to leave Upchurch and would not be able to continue running the scout and cub troops. Cyril Robinson from Drakes Close took over the scouts while Reverend Bradshaw and Kay Donald re-started the cubs. Mrs. Slight and Mrs. Cooling took over the guides and Mrs. Bradshaw took control of the brownies with the assistance of her daughter Jenny.
Finally, baptisms for October included Joanne Liston from Kent Terrace, Stephen and Lorraine Clark from Otterham Quay and Carl Bowden from Oak Lane in a month of varied activities in the village.

Upchurch Parish Council Report - October 2013

The Parish Council met on Thursday 5th September in the Hall of Holywell Primary School where 7 Councillors were present and 11 members of the public, including Cllr Mike Baldock.
Public TimePlanning Application ref SW/13/1039 – A resident raised his objections to this proposal commenting that it was “garden grabbing” of properties at 4 and 6 Horsham Lane, not in keeping with the village and incorrectly displayed on the UK Planning website. He urged members to consider this and reject the application. Cllr Tucker commented that his views would be noted. The Planning Review Team was responsible for submitting observations on this proposal but in this case, all members had been asked to view the plans Monthly expenditure of the Council – A resident referred to several payments made on a regular basis and questioned if the Council was getting value for money.  Fly tipping – It was pointed out that Swale BC would attend any site where this had occurred and takes photos for evidence. Speeding in Oak Lane near Wallbridge Lane – A resident read out an email sent to the Council and updated members. She advised that PCSO Cork had recorded sufficient evidence to confirm that there was a speeding problem at this location. Cllr Tucker thanked her for being proactive and that this issue had been known for a while. The Council was looking at traffic issues around the village and would be finding out how other villages are tackling this. Spotlight outside tower of St Marys Church – It was commented that this light was too bright and needed adjusting. The Clerk will contact the PCC. Bus Stop at Windmill Hill – A resident reported that this was not fit for standing on. Cllr Arnold offered to follow this up. Windmill Hill footpath – It was also commented that it was dangerous walking up and down this hill. Wallbridge Lane – Two residents commented that there was a large amount of litter accumulating along this lane and speeding issues continued. They were pleased to find that the salt bin had finally been replaced. They commented that the speed limit needed to be reduced from 60mph to 30mph. Planning Application SW/13/1039 – A resident raised concerns about the impact of this proposal on several houses. He was asked to forward his comments to the Clerk. He also commented on the speeding issues along Horsham Lane and reported that a car had nearly skidded into his parked car. Parking in Forge Lane and installing a bus shelter in the village – Cllr Baldock asked members for their comments regarding this. It was commented that these were ongoing issues and requested that he let the Clerk know if he had further information/advice.
Planning - The following applications were considered:
 i) SW/13/0913 5 Woodruff Close – Conversion of one of two garages to study – The Planning Review Team had no objections.
ii) SW/13/0964 Field to the rear of 32-62 Hartlip Hill – Proposed four loose boxes, barn, tack room, ménage, muck heap and one horse trailer – The Planning Review Team had no objections.

Allotments and Recreation Ground –  Bollards on Recreation Ground Car Park It was advised the Scout Group did have concerns about installing bollards on the boundary of the car park. It was suggested to investigate installing lockable bollards that could be removed. It was agreed that the GPC would discuss this further. Allotments and Recreation Ground Lease RenewalCllr Lewin had submitted a paper outlining the history of the lease and the suggested rental. This had been circulated to all members prior to the meeting. He had proposed that the Council agree the approach of the local agent and offer to pay a revised rental of £1,065 per annum. With 5 votes for and 2 against, the proposal was accepted.
Paddock Paddock projectIt was advised that all volunteers had been contacted to see if they would be interested in taking the lead regarding the play equipment. The members involved in the project would continue with looking into the tree work required. Two volunteers had shown an interest and would like to meet with members. Members arranged to meet to discuss this further and agree the completion of the planning application for tree works in the Paddock. Play Safety Inspection ReportIt was pointed out that a few issues had been highlighted regarding the litter bins and debris of leaves in the old play area. Cllr Tucker asked for member’s comments on removing the old play area. It was generally felt that it would be a good idea to start this process.
Burial Ground and ChurchyardMeeting with St Marys Churchwardens The Churchwardens had confirmed at the meeting that cremated remains can be buried in a closed churchyard, providing the necessary faculty was obtained. It was also noted that Cllr Rossiter was looking into the consecration status of the Burial Ground rose-beds. Investigations had indicated that the rose-beds were not included in the consecration. Proposals concerning the management of the capacity in our Burial Ground Statistics on the usage of the Burial Ground over the last three years had been circulated. It was pointed out that in terms of land usage about one quarter of our burials were non-parishioners. Members considered this and agreed to cease allowing the burial of non-parishioners in our Burial Ground.  It was noted that this was a temporary measure and the word “burial” applied to both an earthen grave and ashes plot.
Next meetings – 3rd October and 7th November. Please note that the meetings are held in the Hall of Holywell School and start at 7:30pm.

The Gullands guide to Declarations of Trust

It is not uncommon for unmarried couples, family members, friends or business partners to purchase a property together and to make unequal contributions to the purchase price. In these circumstances the preparing of a Declaration of Trust will provide clarity and may help to avoid disputes in the future in the case of death, relationship breakdown or sale of the property.

The main issues covered in the Declaration of Trust are:

Unequal contributions. The Declaration of Trust sets out the respective contributions of the parties and how the proceeds are to be split in the event of a sale of the property or a dispute between the parties. This can be done by reference to a percentage figure, for example 60/40 or 70/30 or alternatively the Declaration of Trust could provide that one party is to receive a fixed sum because that party has, for example, paid the deposit on the purchase price. The balance of the net proceeds of sale can then be split either equally or unequally between them depending on the contributions that they have made and the terms of the Declaration of Trust. If the Declaration of Trust is prepared on the basis of a fixed sum then this provides certainty that it will not take into account any fluctuations in the house price.

Mortgage payments. Frequently parties purchasing a property need the assistance of a mortgage and in those circumstances a Declaration of Trust can specify whether or not the contributions to the mortgage payments are to be equal or not. The same applies to any other outgoings on the property.

Option to purchase. The Declaration of Trust will generally include an option to purchase so that if any other parties wish for the property to be sold or to acquire the other party’s interest they will have an option to purchase and to keep the home. The Declaration of Trust can provide that in the event that the value of the share cannot be agreed between them that an independent surveyor is appointed to determine the price.

Parental contributions. More and more young people look to their parents to assist them with the purchase of a property and a Declaration of Trust can be used to protect the contribution made by the parents. As with contributions made by the parties themselves, parents may wish to take a percentage of the net proceeds of sale or to have their interest protected by reference to a fixed sum of money.

Sometimes it is difficult with regard to timescales or physical location of the parties for a full Declaration of Trust to be entered into. The Land Registry has recently introduced a “Form JO” as an alternative means for joint owners to declare their interests or to provide details of an existing separate Declaration of Trust.

The existence of a Declaration of Trust and/or a third party’s interest in the proceeds of sale can be protected by the registration of a restriction at the Land Registry.

In the absence of any contrary indication, the Land Registry will register joint owners as tenants in common with a presumption that they have an equal separate share in the property. Therefore if this is not the situation or the wishes of the parties then this does need to be expressly set out.

KCC's - Response to Residents Concerns Over Amended 327 Bus Service Timetable

Recent changes to the 327 Bus Service timetable are

inconveniencing many Upchurch residents.
A response from Kent County Council to Swale Rural Forum 27th of August 2013 Agenda Item No. 10 has been published.

326 / 327 Bus Service:

As you may be aware, 80% of bus services in Kent are operated commercially for profit with the remaining 20% supported financially by KCC. The majority of the 326/7 timetable is operated on a commercial basis by Chalkwell with little involvement from KCC. KCC provides financial support for certain early morning and evening journeys and the weekend timetable. KCC are aware however of the reasoning behind changes made in April this year to the service

Changes were made due to traffic problems causing significant delays to journeys which in some cases were causing students to be late for school. Chalkwell were aware that they were having issues serving the previous timetable due to delays getting to and from Sittingbourne in both the morning and the evening peak, a view which was confirmed through observations by the KCC local bus inspector for the area. Times were therefore changed to help the service run as close as possible to the registered timetable and meet school times. It is a requirement of the Traffic Commissioner for services to run to time as far as possible so this was not just a “nice to do” but a legal requirement. Chalkwell have received a lot of positive comments in relation to the changes made and did advertise the revised timetable through on bus notices and contact with schools.

The service timetable is constantly under review and comments are welcomed from users. It is suggested that in the first instance comments or concerns are raised with the operator Chalkwell due to the commercial nature of much of the timetable.

The Operations Manager at Chalkwell is Andy Bates. Email:  andy.bates@chalkwell.co.uk

Upchurch Parish Councillor Pat New's item about the amended 327 Bus Service timetable is on the Swale Rural Forum agenda (item 10) here:
